Terms of Service

1. Acceptance of terms

By using Sailing+ (the "Service"), you agree to these Terms of Service. If you do not agree, you may not use the Service.

2. Description of service

Sailing+ is a sailing trip marketplace. Organizers (operating as Teams) create and publish adventure listings with descriptions, stops, boats, crew, and images. Seekers browse these adventures publicly without needing an account.

Each adventure page displays the organizer's contact channels (WhatsApp, Telegram, email, or Instagram) so seekers can reach them directly. Sailing+ does not process payments, handle bookings, or facilitate transactions between organizers and seekers. All arrangements and payments happen directly between the parties, outside of Sailing+.

3. User accounts

Sailing+ uses passwordless magic link authentication. You provide your email and receive a secure login link. You are responsible for keeping your email account secure, as it is the sole method of authentication.

Organizers must create or join a Team to publish listings. Teams can have multiple members with different roles. Seekers can browse all published adventures without signing in.

4. Organizer responsibilities

As an organizer, you agree to:

  • Provide accurate adventure descriptions, including itineraries, boat specifications, crew qualifications, and pricing.
  • Maintain valid contact information so seekers can reach you.
  • Comply with all applicable laws, including maritime safety, tourism licensing, passenger transport, and insurance requirements.
  • Bear full responsibility for the safety and execution of your trips.
  • Keep listings up to date and remove adventures that are no longer offered.

5. Marketplace terms

Sailing+ is a listing and discovery platform only.

Sailing+ does NOT:

  • Process bookings or payments between organizers and seekers.
  • Guarantee the quality, safety, or legality of any listed trip.
  • Verify organizer credentials, licenses, or insurance.
  • Mediate disputes between organizers and seekers.
  • Act as an agent, broker, or intermediary.
  • Provide insurance or liability coverage for trips.

All arrangements between organizers and seekers—pricing, scheduling, cancellations, safety—are entirely between those parties.

6. User content

All texts, photographs, images, and other content displayed on Sailing+ are uploaded and published by users (organizers and team members). Sailing+ does not create, verify, or endorse any user-submitted content.

You retain ownership of content you submit. By posting, you grant Sailing+ a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating the Service.

You are solely responsible for all content you upload, including ensuring that you hold the necessary rights, licenses, and permissions for any text, images, photographs, or other materials. You warrant that your content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights, and that it does not contain illegal or harmful material.

Sailing+ is not responsible or liable for any user-uploaded content, including but not limited to its accuracy, legality, or potential infringement of third-party rights. We act solely as a hosting platform and do not monitor or pre-screen user content.

7. AI-assisted content

Sailing+ uses AI services internally to generate adventure descriptions and translate content into multiple languages. This content may contain errors or inaccuracies.

You are responsible for reviewing any AI-generated or AI-translated content before publishing. You remain responsible for all content published under your account.

8. Subscription and billing

Organizer Teams need an active subscription to publish adventures. Subscriptions are billed through Stripe.

  • Subscriptions renew automatically (monthly or annually) until cancelled.
  • You can cancel any time through your team's billing settings. Cancellation takes effect at the end of the current billing period.
  • No refunds for partial billing periods.
  • We may change pricing with reasonable advance notice.

9. Intellectual property and copyright

The Sailing+ name, logo, and design are the intellectual property of Iurii Sidorov. You may not use Sailing+ branding without written permission.

Copyright infringement and takedown requests

Sailing+ respects the intellectual property rights of others. If you believe that content hosted on Sailing+ infringes your copyright or other intellectual property rights, please send a takedown request to support@sailing.plus including:

  • A description of the copyrighted work you claim has been infringed.
  • The URL or location of the infringing material on Sailing+.
  • Your name, email address, and (if applicable) the organization you represent.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receipt of a valid takedown request, we will promptly remove or disable access to the allegedly infringing content and notify the user who uploaded it. Repeat infringers may have their accounts terminated.

10. Prohibited activities

  • Creating fake or misleading adventure listings.
  • Scraping or automated data collection without permission.
  • Harassing, threatening, or abusing other users.
  • Spamming or sending unsolicited messages.
  • Creating multiple accounts to circumvent restrictions.
  • Interfering with or compromising the Service's security.

11. Limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Sailing+ is not liable for:

  • The quality, safety, or legality of listed trips.
  • Disputes, losses, or injuries arising from interactions between organizers and seekers.
  • Loss of data, revenue, or business opportunities.
  • Service interruptions or technical issues.
  • Actions of third parties, including payment processors.

Total liability shall not exceed the amount you paid us in the 12 months before the claim.

12. Termination

We may suspend or terminate your account at any time for violating these Terms. Upon termination, your listings are removed and access ceases. You may also delete your account by contacting support@sailing.plus.

13. Changes to terms

We may update these Terms. Changes will be posted here with a revised date. Continued use after changes means you accept the new Terms.

14. Governing law

These Terms are governed by Spanish law. Disputes are subject to the courts of Girona, Spain.
